Cross-Border Estate Advisory
Indian Inheritance Tax & Transferring Inherited Wealth to the UK
Inheriting money, property or other assets in India can involve more than establishing your entitlement to an estate. If you live in the United Kingdom, you may also need to understand Indian tax requirements, UK Inheritance Tax rules, foreign-exchange regulations and the procedures for transferring inherited funds into a UK bank account.
Indian Heritage Services (IHS) assists UK-based individuals and overseas families with the documentary and administrative aspects of Indian inheritance matters. We help clients understand the practical steps involved in identifying inherited assets, gathering supporting documents and coordinating enquiries in India.
Whether you have inherited cash, savings, land, a house, shares or other family assets, it is important to establish the correct procedure before selling property or transferring substantial sums internationally.
Our aim is to help you understand the process, organise the necessary documentation and identify when specialist tax or legal advice is required.
Statutory Rules
A clear assessment of cross-border estate laws helps beneficiaries avoid unexpected liabilities between the Indian Income Tax Department and HMRC.
Is There Inheritance Tax in India?
Will You Have to Pay UK Inheritance Tax?
India abolished estate duty in 1985. Consequently, there is currently no direct inheritance tax or estate duty charged upon the transfer of inherited assets or ancestral capital to legal heirs under Indian succession statutes.
UK Inheritance Tax generally applies based on the domicile status of the deceased person. If the deceased was non-UK domiciled and the assets were situated solely in India, UK IHT does not ordinarily attach to the overseas estate.
UK Tax on Receipt & Double Taxation
Inheriting Property & Remittance Limits
Receiving inherited capital into the UK is not treated as income for UK tax purposes. Under the UK-India Double Taxation Avoidance Agreement, tax paid on Indian capital gains can be credited against any UK capital liability, preventing double taxation.
When selling inherited Indian property, proceeds must be deposited into a designated Non-Resident Ordinary account. Under Reserve Bank of India FEMA provisions, non-residents may repatriate up to US$1 million per financial year.
As at October 2026, India does not have a general inheritance or estate tax comparable to the UK's Inheritance Tax.
Under India's income-tax legislation, money or property received under a will or by way of inheritance is generally excluded from the gift-tax charge under Section 56(2)(x). This does not mean that every transaction connected with an inherited estate is tax-free.
Tax may still arise in connection with the assets themselves, including income earned from inherited investments, rental income or the sale of inherited property.
The appropriate treatment depends on the asset, the circumstances of the inheritance and the applicable Indian tax rules.
Receiving an inheritance from India does not automatically mean that you must pay UK Inheritance Tax simply because you live in Britain.
The relevant question is whether the deceased person's estate, the assets concerned and the circumstances of the transfer fall within the UK's Inheritance Tax rules.
Since 6 April 2025, the UK has generally used a long-term residence test to determine whether overseas assets are within the scope of Inheritance Tax. Broadly, a person may be treated as a long-term UK resident if they have been UK tax-resident for at least 10 of the previous 20 tax years, subject to detailed rules and exceptions.
Where the deceased was a long-term UK resident, overseas assets they owned may be within the scope of UK Inheritance Tax. Other rules may apply where the deceased was not a long-term UK resident, where UK assets are involved or where trusts and lifetime gifts are relevant.
In many cases, any Inheritance Tax due is dealt with by the estate's personal representative before assets are distributed. There are circumstances in which a beneficiary may have a separate liability.
Important: Your own UK residence and the deceased person's residence history are not the same question. Both may need to be examined, alongside the location and ownership of the assets.
IHS can help organise the inheritance information and supporting documents needed for an initial assessment. A UK tax adviser should confirm whether Inheritance Tax is due and whether any reporting or payment obligations arise.
Repatriation Pathways

Transferring estate funds requires compliance with Reserve Bank of India guidelines, authorised dealer protocols, and stringent UK anti-money laundering verification.
Direct Bank-to-Bank Transfer
Regulated Foreign-Exchange Providers
Transfers in Stages
Telegraphic international transfer from an Indian Authorised Dealer bank directly to your UK account. Offers standard institutional security backed by formal Foreign Inward Remittance Certificates.

Staggering remittances across financial years or tranches to remain within the annual US$1 million FEMA quota, manage currency market volatility, and satisfy staged compliance milestones.
Why Documentation Matters
Indian banks cannot remit inheritance capital overseas without Form 15CA and Form 15CB certifications from a chartered accountant verifying tax clearance. Concurrently, UK receiving banks enforce rigorous source-of-wealth scrutiny to clear inbound sums without freezing funds.
Your bank may ask where the money came from and request evidence that it represents a genuine inheritance or the proceeds of an inherited asset.
A transfer through the banking system does not remove any tax liability that may already exist. Likewise, transferring the money in stages does not, by itself, reduce tax.
The appropriate objective is a lawful, traceable transfer with the correct paperwork and a clear record of the funds' origin.
If you inherit a house, land or another asset in India, you may need to complete several steps before the proceeds can be transferred overseas.
Depending on the circumstances, the process may involve:
Establishing your entitlement to the inherited asset.
Obtaining relevant succession, probate or other documentation, where required.
Confirming the ownership and registration position.
Obtaining professional advice on any Indian tax arising from a sale.
Completing the sale and retaining evidence of the transaction.
Confirming the applicable Reserve Bank of India (RBI) foreign-exchange requirements.
Arranging an authorised bank transfer to your bank account.
The correct procedure depends on the type of asset, your residence and nationality status, how the asset was inherited, the source of the funds and the amount involved.
Do not assume that inherited property can be sold or its proceeds transferred overseas without checking the relevant requirements first.
Common Inquiries
Frequently Asked Questions
Is inherited money from India taxable in the UK?
Does India charge inheritance tax?
Pure inherited capital is not subject to UK income tax upon transfer. However, any subsequent income or gain generated by the capital after entitlement may fall under UK tax obligations.
No. Indian tax statutes do not levy inheritance tax or estate duty. Capital gains tax is only triggered if an inherited asset is liquidated, calculated based on the previous owner's cost basis.
Can I transfer inherited money directly to my UK bank account?
Can I transfer more than US$1 million?
Yes, provided the funds pass through an NRO account held in an Indian authorised dealer bank and are accompanied by necessary 15CA and 15CB certifications alongside succession documentation.
Remittances exceeding the annual US$1 million limit under FEMA require prior approval from the Reserve Bank of India, supported by comprehensive legal and financial justifications.
Should I sell inherited property before transferring the money?
Will my UK bank ask where the money came from?
Immovable assets cannot be remitted overseas as property. The real estate must either be liquidated in India or retained to yield rental income, which can then be transferred via standard channels.
Yes. UK institutions enforce stringent anti-money laundering checks on high-value inbound transfers and will require formal Indian probate records, deeds, and tax documents as proof of legitimate origin.
Could You Be Taxed Twice?
Cross-border inheritance matters can involve tax rules in more than one country. The outcome depends on the assets, the people involved, the relevant tax laws and any available relief.
